Incredibly, Portuguese nationals and companies could not travel to the United States under E visas.
The E-type treaty trader (E-1) and treaty investor (E-2) visas are for nationals of countries with which the United States has trade and navigation treaties. Although the ‘AMIGOS Act to Promote Mutual Interests and Grow Our Success’ (AMIGOS Act) was signed into law by President Joseph Biden in December 2022, its full implementation has not taken place until last April.
The role of the AMIGOS ACT for E visas for Portugal
The AMIGOS ACT is designed to facilitate business and trade, through a new non-immigrant category for Portuguese nationals, the E1 and E2 trade and investment visas.
What does the E1 visa for the United States allow?
The E1 visa for the United States allows nationals of a treaty country to be admitted to the United States solely to engage in international trade, primarily between the United States and the treaty country.
What does the E2 visa for the United States allow?
The E2 visa for the United States allows a national of a treaty country to be admitted to the United States when he or she invests a substantial amount of capital in a US company. It also allows workers of such a company.
Thanks to this law, both Portuguese nationals and companies with more than 50% of their capital of Portuguese origin will be eligible to apply for this type of visa for the United States.
