CHANGE OF STATUS IN THE UNITED STATES, FROM L1 TO E2

How is the process of changing status in the United States?

A few months ago Visados Empresas was contacted by an important Spanish company dedicated to global services and projects. They wanted to hire a Financial Manager of Spanish nationality in their subsidiary in the United States. 

The employee was currently working for another company in the United States on an L1-A visa and his wife was working with him for another company on an L-2 dependent visa. As they had been living in the United States for several years and the E visa appointments at the Embassy in Madrid were several months away, we offered them a change of status in the United States so that he could take up his new job as soon as possible.

How to apply for a change of status in the US?

We got to work with the US affiliate and the worker and prepared the file to send it as soon as possible. Almost two hundred pages of file plus the forms were on their way to USCIS. In this case, our client opted to add the i-907 form so that USCIS would get back to us in no more than 15 working days.

In that period, USCIS asked us to send an additional document. We prepared another small file which we uploaded with additional documents and evidence to secure approval. A few days later, the notification of the change of status in the United States was a fact, our client had obtained his E-2 visa for the United States and could start working with his new employer without having to leave the United States.

At the same time, we arranged a change of dependent status for his wife, so that she could change from L-2 to E-2.

But of course, the change of status allowed them to continue with their life in the United States, but they could not leave and re-enter because the US visa they had in their passports was the L visa, which was no longer valid. What did we do? Well, a couple of weeks ago, taking advantage of a visit to Spain, they had their appointment at the US Embassy in Madrid which we had planned a few months in advance. Last week, the couple received their passports with their E visas for the United States with a validity of 5 years.
